A TikTok creator, Leigh Sutherland, who gained a following by portraying himself as a road traffic lawyer, has been jailed for nine years after causing the death of a 77-year-old grandmother, Margaret Allan, in a dangerous driving incident. The High Court in Glasgow delivered the sentence on January 9, 2026, following a trial that revealed Sutherland’s reckless actions and subsequent attempts to evade responsibility.
The tragic collision occurred on June 15, 2023, near Cumbernauld, Lanarkshire, when Sutherland, then 31, was driving an aging Ford Mondeo with defective brakes. He was speeding at a minimum of 44 mph in a 40 mph zone, and likely faster, when he crashed into Ms. Allan’s Peugeot 108. Margaret Allan, described by her family as the “absolute heart” of their community, was driving her 10-year-old grandson home from school at the time. She sustained severe injuries and tragically passed away weeks later, on July 6, 2023. Her grandson also suffered injuries.
A Fatal Crash and a Blatant Disregard for Life
The immediate aftermath of the crash painted a grim picture of Sutherland’s conduct. Instead of offering assistance or taking responsibility, he attempted to flee the scene. Police officers had to apprehend him as he walked away, claiming he needed time “to clear his head.” During this encounter, Sutherland made appalling remarks, blaming Ms. Allan for the collision and reportedly stating, “It would not have happened if the f*****g b***h had not pulled out.” He also repeatedly swore at the arresting officer, branding him “a f***ing idiot.” Such derogatory comments and his attempt to escape were highlighted by Judge Tom Hughes during the sentencing, emphasizing Sutherland’s “totally and utterly unacceptable” attitude.
The investigation into the crash revealed critical mechanical failures in Sutherland’s 12-year-old Ford Mondeo. The anti-lock braking system was not functioning, and the vehicle’s battery was unsecured. Prosecutors argued that Sutherland had ignored warnings about the faulty brakes. Adrian Stalker, the prosecutor, told jurors that Sutherland’s driving was “not just a lack of judgement or momentary inattention” but rather “dangerous,” as he was “going far too fast” in a “defective” car, according to STV News.
The TikTok Persona vs. Reality
Leigh Sutherland was not an unknown figure online. Under the name Lee Sutherland, he had cultivated a significant presence on TikTok, where he frequently posted videos claiming to be an experienced criminal defense and road traffic solicitor. In some clips, he even dressed as a police officer. One video, cited in court, featured him stating, “Hello I’m Lee Sutherland and I’m based in Glasgow. I almost have eight years of experience of the criminal side of the law, and I am also a criminal defence solicitor as well. I also have experience of road traffic law and the criminal side of the law.” This fabricated persona starkly contrasted with his real-world actions and his blatant disregard for road safety and the law.
Adding another layer to his history of legal troubles, it was revealed that Sutherland had been banned from driving for six months just one week before the fatal crash. His actions, including his attempts to leave the scene without providing details, demonstrated a pattern of disrespect for regulations he publicly claimed to understand and even practice. Furthermore, while on remand awaiting trial, Sutherland continued to post videos on the internet about the case, actions Judge Hughes deemed “totally inappropriate for someone facing such serious matters.”
Justice Served, But Loss Remains
During the trial, Sutherland maintained his innocence, a stance his defense solicitor, Graham Brown, stated he continued to hold during interviews for a criminal justice social work report. Brown also mentioned that Sutherland’s life had been “dictated by autistic spectrum disorder” and that he had worked “sporadically.” However, this did not sway the court’s view of his culpability or his lack of remorse.
Judge Tom Hughes did not mince words during sentencing. He highlighted Sutherland’s “cock and bull story” to police, where he claimed a Romanian man had taken his car for a test drive at the time of the incident. Judge Hughes stated, “Your attitude was totally and utterly unacceptable, you proceeded to walk away from the area, paying no regard to those you injured and left them to their fate.” He continued, “As a result of your actions, their lives have changed radically from what they expected to enjoy for years to come – they have suffered a catastrophic loss.” Sergeant Andy Coutts of North Lanarkshire roads policing echoed this sentiment, stating, “Sutherland’s actions showed a blatant disregard for other road users and the law, and since the incident he has showed no remorse,” as reported by The Scotsman.
Leigh Sutherland was found guilty of causing death by dangerous driving and was sentenced to nine years in prison. He was also handed a driving ban for more than 13 years. The court’s decision was a measure of justice for Margaret Allan’s family, who sat through the traumatic trial with “great dignity and courtesy.”
Outside the court, Margaret Allan’s son, John Allan, delivered an emotional statement. “While today’s sentencing brings a measure of justice, we recognise that no outcome will ever bring our mum back,” he said. “We hope, however, that this conclusion allows us to move forward and brings some sense of closure. Our mum was independent, active and the absolute heart of our family and our community.
