A central pillar of Scott’s argument for the bill’s passage is the inclusion of new ethics language, which he described as an unprecedented concession by President Trump. According to Scott, the administration’s willingness to comply with strict ethics standards for elected officials removes the primary argument used by Democratic critics to block the legislation.

The Clarity Act, which aims to establish a regulatory framework for digital assets, passed the Senate Banking Committee in May 2026 with a 15-9 bipartisan vote. Scott argued that the current lack of regulatory standards for crypto rewards leaves both firms and consumers in a state of uncertainty. He maintains that the bill provides necessary “rules of the road” that protect everyday investors and ensure innovation remains within the United States.

Senate Agenda and Legislative Hurdles

The push for the Clarity Act occurs as the Senate faces a congested end-of-session agenda. Alongside the digital asset legislation, the chamber is tasked with resolving government funding, the National Defense Authorization Act (NDAA), and proposed Russia sanctions.
