Allegations of Procedural Interference
Minister for Foreign Affairs Helen McEntee, who previously served as Minister for Justice, faced intense questioning in the Dáil this week following an RTÉ Investigates documentary regarding the handling of Garda (Irish police) whistleblowers. The controversy centers on allegations that McEntee acted “without legal authority” by redirecting a protected disclosure made by Det Supt Brian O’Reilly back to An Garda Síochána, rather than allowing an investigation by her department’s secretary general.
Labour justice spokesman Alan Kelly accused the Minister of “usurping the role” of the Office of the Protected Disclosure Commissioner (OPDC) in 2023. According to The Irish Times, the OPDC had issued a statutory direction for the secretary general to investigate the claims. However, Kelly alleged that McEntee intervened to remove the investigation from that office and redirect it to the police force itself, effectively exposing the whistleblower’s identity and undermining the legal protections afforded to him.
The Holster Controversy
At the heart of Det Supt O’Reilly’s disclosure were serious concerns regarding the safety of standard-issue holsters used by more than 1,600 armed gardaí. O’Reilly alleged that the equipment was defective and may have contributed to the serious injury of an officer during an accidental discharge, as well as the tragic murder of Det Garda Colm Horkan in June 2020. Despite these warnings, opposition spokespeople, including the Social Democrats’ Gary Gannon, argued that the institution prioritized protecting its reputation over investigating the substance of the claims. The Irish Mirror reported that O’Reilly faced severe pushback from senior management after validating the concerns internally.
Government Response and Political Tension
In the Dáil, Minister McEntee maintained that she had adhered to all rules and regulations provided to her. Regarding the specific redirection of the disclosure, she noted that she is legally precluded from commenting on or confirming the existence of specific protected disclosures, especially those currently before the courts or tribunals. She further stated that procurement remains a matter for the Garda, not the Ministry of Justice. Opposition parties, led by Labour, have branded the government’s refusal to schedule a full Dáil debate on the matter as “completely unacceptable,” citing deep public concern over the treatment of those who report internal malpractice.
