A compensation portal for consumers impacted by the 2024 listeria outbreak linked to plant-based beverages has officially opened. The class-action settlement, approved by the Superior Court of Quebec, allows Canadians who purchased or consumed recalled Silk and Great Value products to file claims until October 16, 2026.
Eligibility and Compensation Tiers
The settlement follows a recall initiated by Danone Canada on July 8, 2024, which impacted various almond, coconut, oat, almond-coconut, and almond-cashew milk products. According to the Public Health Agency of Canada, the contamination resulted in approximately 20 reported illnesses, 15 hospitalizations, and three deaths.
Compensation is determined by a severity grid. Eligible claimants can receive:
- $400: For symptoms lasting up to 48 hours.
- $1,500: For symptoms lasting up to one week.
- $7,000: For non-hospitalized individuals with symptoms lasting longer than one week.
- Up to $300,000: For the most severe cases, including those resulting in hospitalization or death.
Family members and dependents of those affected are also eligible to file claims. While the settlement fund covers legal fees and administrative costs, Danone Canada and Walmart Canada continue to deny all allegations of wrongdoing or liability.
Understanding the Risk
Listeria is a resilient bacterium that thrives in cold, moist environments. Dr. Dale Kalina, an infectious diseases specialist, noted that while healthy individuals may recover from mild gastroenteritis, the bacteria pose significant risks to pregnant women, children under two, and adults over 60. Symptoms can take up to 70 days to manifest, making identification of the source critical for public health tracking.
