Legal Escalation in Manhattan

First lady Melania Trump filed a motion for sanctions against biographer and journalist Michael Wolff on Tuesday, intensifying a protracted legal dispute. The motion follows a federal judge’s earlier dismissal of an anti-SLAPP lawsuit initiated by Wolff, which had aimed to preemptively shield the journalist from a potential billion-dollar defamation claim regarding his commentary on the Trumps’ alleged connections to Jeffrey Epstein.

In her 26-page filing in Manhattan, the first lady accused Wolff and his legal team of weaponizing the federal court system for a “fundraising drive and a political spectacle.” Her motion demands that Wolff cover the legal fees and expenses incurred during the proceedings, arguing that his original lawsuit lacked evidentiary support and was designed to harass her publicly.

Judicial Scrutiny of Litigation Tactics

The motion stems from a May ruling by U.S. District Judge Mary Kay Vyskocil, who dismissed Wolff’s case on the grounds that it was filed prematurely. Judge Vyskocil, an appointee of Donald Trump, heavily criticized Wolff’s legal strategy, characterizing his attempt to force a favorable jurisdiction as an “inappropriate level of tactical gamesmanship.”

Despite the court’s ruling in her favor, Judge Vyskocil had previously signaled caution to the first lady, noting during a July 1 conference that there is a “very high burden” for success in sanctions motions and questioning whether continued litigation serves the interests of either party. Melania Trump’s legal team opted to move forward, citing the judge’s own findings regarding the “abusively presented” nature of the original lawsuit.

Financial and Political Stakes

The conflict centers on Wolff’s reporting regarding the Trumps’ social ties to the late financier Jeffrey Epstein. Wolff has utilized his Substack account and a GoFundMe campaign—which has raised over $836,000—to fund his legal efforts and continue public critiques of the couple. The first lady’s motion specifically highlights what it describes as false and irrelevant assertions made in Wolff’s court filings regarding her personal life and marriage.

The first lady has sought to distance herself from Epstein’s criminal activities, releasing a recorded statement in April asserting that she was never a friend of the convicted sex offender and that any overlapping social appearances in New York or Palm Beach were merely incidental.
